Terms and Conditions of Sale

1. General information and seller identification

These Terms and Conditions of Sale (hereinafter “Terms”) govern the purchase of products made through the website alberodigodot.it (hereinafter “Website”).

By placing an order through the Website, the customer acknowledges having read, understood, and accepted these Terms in full. Customers are invited to read them carefully before completing a purchase and to save or print a copy for their records.

2. Scope of application

These Terms apply to all sales of products made through the Website to consumers (natural persons acting for purposes unrelated to any business, commercial, craft, or professional activity they may carry out) and to business customers. For consumers, the provisions of Italian Legislative Decree 206/2005 (Consumer Code) and other applicable consumer protection regulations also apply.

The Seller reserves the right to amend these Terms at any time. The Terms applicable to any given order are those in force at the time the order is placed by the customer.

3. Products

The products sold on the Website are extra virgin olive oils produced in Italy, in the Capalbio area (Tuscany). Product information (description, images, prices, available formats) is set out in the relevant product pages published on the Website.

Product images are for illustrative purposes and may not be perfectly representative of the actual characteristics of the product (colour, dimensions, accessories). In the event of any discrepancy, the written description in the product page shall prevail.

The Seller reserves the right to modify the range of products offered on the Website at any time.

4. Prices

All prices shown on the Website are expressed in Euros (€) and are inclusive of VAT where applicable. Shipping costs are not included in the product price and are calculated and displayed separately before the order is confirmed.

The Seller reserves the right to modify prices at any time, it being understood that the price charged to the customer shall be that displayed on the Website at the time the order is placed.

5. Ordering process

To make a purchase, the customer must:

  • Select the desired product and add it to the shopping cart;
  • Review the cart contents and proceed to checkout;
  • Enter the required shipping and billing details;
  • Select the preferred payment method;
  • Review the order summary and confirm the order.

Submitting an order constitutes a binding purchase proposal by the customer. The sales contract is deemed concluded when the customer receives the order confirmation email from the Seller. The Seller reserves the right not to accept orders that are incomplete, contain errors, or present payment issues.

Purchases may be made either by registering a personal account or as a guest. Registration allows customers to manage orders, view purchase history, and simplify future purchases.

6. Payment methods

The Website accepts the following payment methods:

  • Credit or debit card (via Stripe): Visa, Mastercard, American Express, and other supported networks;
  • PayPal;
  • Bank transfer. For payments by bank transfer, the order will only be processed after the full amount has been credited to the Seller’s bank account. Bank details will be provided at the end of the ordering process.

Payment data is processed directly by the payment service providers (Stripe and PayPal) in secure, certified environments. The Seller does not store or have access to the customer’s credit card data or PayPal account information.

7. Shipping and delivery

7.1 Delivery zones and costs

The Seller ships to Italy and to selected European Union countries. Shipping costs are as follows:

Italy: standard shipping € 7.00. Free for orders of € 90.00 or above.

Europe (selected countries): standard shipping € 18.00.

Shipping costs are displayed to the customer before the order is confirmed.

7.2 Delivery times

Estimated delivery times are:

  • Italy: 2–3 working days from the date of shipment;
  • Europe: 3–6 working days from the date of shipment.

The times indicated are estimates and do not constitute a binding deadline. Delays caused by the courier, force majeure events, or exceptional circumstances shall not give rise to claims for compensation. The Seller undertakes to notify the customer of any significant delays.

7.3 Delivery

Upon shipment, the customer will receive a confirmation email with tracking information, where available. Upon delivery, the customer should verify the integrity of the packaging and the correct number of parcels. In the event of visible anomalies (damaged packaging, missing parcels), the customer is advised to report them immediately to the courier by accepting delivery with reservation, and to contact the Seller within 48 hours at info@alberodigodot.it.

8. Damaged or defective products

The Seller takes the utmost care in packaging and shipping every order. Should a product arrive damaged (for example, bottles broken during transport) or prove defective, the customer is entitled to a free replacement at no additional cost.

To request a replacement, the customer must:

  • Contact the Seller within 7 days of receiving the order by writing to info@alberodigodot.it;
  • Provide a description of the issue and, where possible, photographic evidence of the damage;
  • Follow the Seller’s instructions for the possible return of the damaged product.

The Seller will dispatch the replacement product as promptly as possible and at no cost to the customer.

The statutory guarantee of conformity provided for by Articles 128–135 of the Italian Consumer Code remains applicable for consumers, with a duration of 2 years from the date of delivery.

9. Right of withdrawal

Pursuant to Articles 52 et seq. of the Italian Consumer Code, the consumer has the right to withdraw from the purchase contract within 14 days of receiving the products, without providing any reason and without penalty.

9.1 How to exercise the right of withdrawal

To exercise the right of withdrawal, the consumer must send an explicit communication to the Seller within the 14-day period by writing to info@alberodigodot.it or via certified email (PEC) to godot@legalmail.it. The communication must contain an unambiguous statement of the decision to withdraw, the order reference, and the customer’s details.

9.2 Return of products

The consumer must return the products within 14 days of communicating the decision to withdraw. Products must be returned intact, in their original packaging, unopened, and unused. As these are food products, the right of withdrawal applies exclusively to products whose seal or packaging has not been opened after delivery. Return shipping costs are borne by the consumer.

9.3 Refund

The Seller will refund the full amount paid by the consumer (including original shipping costs, limited to the cost of the least expensive standard delivery option offered) within 14 days of receiving the returned products or proof of their shipment. The refund will be made using the same payment method used for the original purchase, unless otherwise agreed with the customer.

9.4 Exclusions from the right of withdrawal

Pursuant to Article 59 of the Italian Consumer Code, the right of withdrawal is excluded for sealed food products that have been opened after delivery and cannot be returned for hygiene or health protection reasons.

10. Statutory guarantee of conformity

All products sold on the Website are covered by the statutory guarantee of conformity provided for by Articles 128–135 of the Italian Consumer Code. The consumer is entitled to have the conformity of the product restored free of charge, by means of replacement, within 2 years of delivery.

To report a lack of conformity, the consumer may contact the Seller at info@alberodigodot.it.

11. Liability

The Seller shall not be held liable for any failure to perform or delay in performing any obligation under these Terms caused by force majeure events, including but not limited to: natural disasters, strikes, interruptions to transport services, technical failures, acts of public authorities, and any other event beyond the Seller’s reasonable control.

The Seller is not liable for any damage arising from improper use of the product or storage in unsuitable conditions.

12. Intellectual property

All content on the Website — including but not limited to text, images, photographs, logos, trademarks, graphics, design, and software — is the property of the Seller or its respective owners and is protected by Italian and international intellectual and industrial property law.

Any reproduction, distribution, modification, publication, or use of the Website’s content without the prior written authorisation of the Seller is prohibited.

13. Personal data processing

The customer’s personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Italian legislation. For detailed information on how personal data is processed, please refer to the Privacy Policy available on the relevant page of the Website.

15. Governing law and jurisdiction

These Terms are governed by Italian law. For any dispute arising from the interpretation, performance, or termination of these Terms, the courts of the place of residence or domicile of the consumer shall have exclusive jurisdiction, provided the consumer is located in Italy, pursuant to Article 66-bis of the Italian Consumer Code.

For customers who do not qualify as consumers, the Court of Grosseto shall have exclusive jurisdiction.

16. Alternative dispute resolution

Pursuant to Article 14 of Regulation (EU) No. 524/2013, consumers residing in the European Union may use the ODR (Online Dispute Resolution) platform provided by the European Commission for the out-of-court resolution of disputes arising from online sales contracts. The platform is accessible at: https://ec.europa.eu/consumers/odr.
